1) Who We Are

CASAGATOS LLC operates an eCommerce store offering a curated mix of product types, including:

• Made-to-order products produced and fulfilled by third-party manufacturing and print-on-demand partners.
  
• Vintage and secondhand items that are one-of-one and may show natural wear, patina, or imperfections consistent with age and prior use.
  
• New, ready-to-ship products, including but not limited to home décor, candles, apparel, accessories, and lifestyle goods, which may be stocked, packed, and shipped by CASAGATOS directly or through third-party fulfillment providers.
  
• Future product offerings, including additional categories, materials, or fulfillment methods, including items shipped from CASAGATOS-operated or partner warehouses.

2) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase from this Site.

3) Orders, Acceptance & Cancellations

• All orders are subject to acceptance and availability.
  
• We reserve the right to refuse or cancel orders for suspected fraud, pricing errors, misuse, or unauthorized activity.
  
• Made-to-order items generally cannot be canceled or changed once production begins.
  

4) Product Descriptions, Mockups & Variations

We strive for accuracy; however:

• Printed products may show minor placement, sizing, or color variation.

These variations are not considered defects.

5) Vintage & Secondhand Items — “As-Is” Disclosure

Unless explicitly stated otherwise, vintage and secondhand items are sold “as-is.”

• Natural wear, patina, fading, marks, or age-related imperfections are expected.
• Wear visible in photos or reasonably expected for vintage items is not damage.
• Vintage items may contain materials or construction methods no longer used.
• CASAGATOS does not guarantee longevity, structural integrity, or suitability beyond decorative or intended display use.
  

6) Shipping, Risk of Loss & Delivery Confirmation

Risk of loss and title transfer to the customer once the order is handed to the shipping carrier.

• Once tracking shows “Delivered,” CASAGATOS is not responsible for loss, theft, or damage.
• Customers are responsible for providing accurate shipping information and securing a safe delivery location.
• Carrier delays, mishandling, or theft after delivery are outside our control.
  

7) Shipping Damage Claims & Evidence Requirements

If an item arrives damaged during transit, you must contact us within 30 days of delivery and provide:

• Clear photos of the item from multiple angles
• Photos of the external packaging
• Photos of the internal packaging materials
• A clear photo of the shipping label
  

Claims lacking sufficient evidence may be denied.

Claims showing signs of intentional damage, misuse, alteration, or tampering will be denied. CASAGATOS reserves the right to refuse refunds or replacements in cases of suspected fraud or abuse.

8) Product-Specific Disclaimers & Use at Your Own Risk

Candles & Wax Products

• Never leave burning candles unattended.
• Keep away from children, pets, flammable materials, and drafts.
• Always place on a heat-safe surface.
• Improper use may result in fire, injury, or property damage.
• CASAGATOS is not responsible for damage caused by improper use.
  
  

Home Décor & Fragile Items

• Decorative items may be fragile and intended for display only.
• Customers are responsible for safe installation, mounting, and handling.
  

Apparel

• Fit and comfort are subjective.
• Customers are responsible for reviewing size charts.
• Damage from improper washing or care is not a defect.
  

9) Third-Party Fulfillment & Manufacturing

Some products are fulfilled by independent third-party partners. CASAGATOS does not control all aspects of manufacturing and is not responsible for minor production variations, carrier delays, or handling beyond remedies outlined in our Return Policy.

10) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, labor disputes, supply chain disruptions, carrier delays, government actions, or pandemics.

11) Limitation of Liability

To the fullest extent permitted by California law, CASAGATOS LLC shall not be liable for indirect, incidental, consequential, or punitive damages. Our total liability is limited to the amount paid for the product giving rise to the claim.

12) Indemnification

You agree to indemnify and hold harmless CASAGATOS LLC and its owners, employees, contractors, and partners from claims arising from misuse of the Site, violation of these Terms, improper product use, or fraudulent activity.

13) Binding Arbitration & Class Action Waiver (California)

PLEASE READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS

Any dispute arising out of or relating to these Terms, the Site, or any purchase shall be resolved by binding arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

• Arbitration will take place in California.
• You waive the right to a jury trial.
